Refund Policy
Our refund and cancellation policies for the Artemis Targeting platform, operated by CW Ad Agency, a division of Cullari & Wardell, LLC.
This Refund Policy applies to all services provided by CW Ad Agency, a division of Cullari & Wardell, LLC ("Company," "We," "Us," or "Our"), including the Artemis Targeting advertising platform ("Platform"), AI chat agents, AI voice/phone agents, and any other products or services we offer. By subscribing to or using any of our services, You agree to the refund terms outlined below. This policy should be read in conjunction with our Terms and Conditions.
1 General Policy
All sales are final. We do not offer refunds for subscription fees, advertising spend, or any other charges associated with the use of the Artemis Targeting platform.
By completing a purchase or activating a subscription, You acknowledge and agree that You are not entitled to a refund under any circumstances, except as specifically described in Section 5 of this policy.
2 Subscription Fees
2.1 Non-Refundable
Subscription fees are charged in advance on a monthly or annual basis and are non-refundable. This includes partial billing periods—no prorated refunds will be issued for unused time remaining in a billing cycle.
2.2 Auto-Renewal
Subscriptions automatically renew at the end of each billing period. It is Your responsibility to cancel before the next renewal date to avoid being charged. Charges incurred due to failure to cancel are not eligible for refunds.
2.3 How to Cancel
You may cancel Your subscription at any time by providing at least 30 days' written notice to support@artemistargeting.com. Upon cancellation:
- Your access continues until the end of the current paid billing period
- No further charges will be made after the cancellation takes effect
- No refund will be issued for the remaining time in the current period
3 Advertising Spend (Ad-Spend)
ALL ADVERTISING SPEND IS STRICTLY NON-REFUNDABLE. This applies regardless of campaign performance, delivery status, or any other circumstances.
Specifically, no refunds or credits will be issued for Ad-Spend in the following situations:
- Campaigns that are launched but underperform or fail to meet Your expectations
- Campaigns that are paused, terminated, or cancelled—whether by You or by Us
- Campaigns that never launch due to creative rejection, compliance issues, or failure to meet requirements
- Campaigns that deliver zero or fewer impressions than anticipated
- Unused funds remaining in Your Ad-Spend wallet
- Third-party outages, inventory shortages, or supply-side disruptions beyond our control
3.1 Pre-Payment Requirement
All Ad-Spend must be funded in advance via Your wallet before any campaign can launch. By funding Your wallet, You acknowledge the non-refundable nature of these funds.
4 AI Services (Chat Agents & Voice Agents)
4.1 Setup Fees
One-time setup and configuration fees for AI chat agents and AI voice/phone agents are non-refundable. These fees cover the design, development, training, and deployment of Your custom AI agent, which begins immediately upon engagement.
4.2 Monthly Service Fees
Recurring monthly fees for AI agent hosting, maintenance, and usage are non-refundable. This includes partial billing periods—no prorated refunds will be issued if You cancel mid-cycle.
4.3 Usage-Based Charges
Any usage-based charges (including call minutes, message volume, or API usage) are non-refundable once incurred, regardless of call outcome, message delivery, or perceived quality of the AI interaction.
4.4 Cancellation
You may cancel Your AI agent service at any time by providing written notice to support@artemistargeting.com. Upon cancellation:
- Your AI agent will remain active through the end of the current paid billing period
- No refund will be issued for the remaining time in the current period
- No refund will be issued for setup fees previously paid
5 Account Termination
If Your account is terminated—whether by You or by Us for any reason, including violation of our Terms and Conditions—no refunds will be issued for:
- Remaining time on Your subscription
- Unused Ad-Spend wallet balance
- Any active or pending campaigns
6 Exceptions
Refunds may be considered at our sole discretion only in the following limited circumstances:
- Duplicate Charges: If You were charged more than once for the same transaction due to a billing system error
- Incorrect Billing Amount: If You were charged an amount that differs from the published or agreed-upon price
- Unauthorized Charges: If a charge was made without Your authorization (subject to verification)
To request a review under these exceptions, contact us at support@artemistargeting.com within 30 days of the charge in question. Include Your account details and a description of the issue. We will review and respond within 10 business days. These exceptions apply equally to subscription fees, advertising spend, and AI agent service charges.
7 Chargebacks & Payment Disputes
If You initiate a chargeback or payment dispute with Your bank or credit card company instead of contacting us directly, we reserve the right to:
- Immediately suspend or terminate Your account and all active campaigns
- Contest the chargeback with supporting documentation
- Pursue collection of any amounts owed, including reasonable attorney fees and administrative costs
We encourage You to contact us at support@artemistargeting.com before initiating a dispute with Your payment provider so we can attempt to resolve the issue directly.
8 Changes to This Policy
We may update this Refund Policy at any time. Changes become effective upon posting to our website. Continued use of the Platform after changes are posted constitutes acceptance of the updated policy. We recommend reviewing this page periodically.
